Welcome to Hydrovac News. These Terms of Service (“Terms”) govern your access to and use of the Hydrovac News website, newsletter, directory, job board, classifieds marketplace, and related services (collectively, the “Services”) operated by Hydrovac News LLC (“Company,” “we,” “us,” or “our”).

Employers posting job listings agree to provide accurate job descriptions and comply with all applicable employment laws, including anti-discrimination laws. Employers are solely responsible for their hiring decisions and employment practices.

7.2 Job Seeker Responsibilities

Job seekers are responsible for providing accurate information in their applications. We do not verify the credentials or background of job seekers.

7.3 No Employment Relationship

Hydrovac News is not an employment agency and does not act as an employer or employee of any party using our job board. We are not responsible for any employment decisions or outcomes resulting from the use of our job board.

8. Classifieds and Equipment Marketplace Terms

8.1 Listing Requirements

Sellers must provide accurate descriptions, pricing, and images of items listed for sale. Misrepresentation of items is prohibited and may result in removal of listings and suspension of account privileges.

8.2 Transaction Terms

All transactions are conducted directly between buyers and sellers. Hydrovac News does not participate in or guarantee any transaction. We are not responsible for the quality, safety, legality, or delivery of items listed.

8.3 Prohibited Items

The following items may not be listed on our classifieds:

• Stolen property or items with unclear ownership
• Hazardous materials not properly disclosed
• Items that violate any applicable law
• Counterfeit or misrepresented items

9. Directory Listing Terms

9.1 Listing Accuracy

Directory listing holders are responsible for maintaining accurate and current information in their listings, including business name, contact information, services offered, and service areas.

9.2 Verification

While we may verify certain information in directory listings, we do not guarantee the accuracy, licensing status, insurance coverage, or quality of services of any listed business.

9.3 Reviews and Ratings

If our Services include reviews or ratings, users agree to provide honest and accurate feedback. Fake reviews, whether positive or negative, are prohibited and may result in account termination.

10. Third-Party Links and Services

Our Services may contain links to third-party websites or services that are not owned or controlled by Hydrovac News LLC. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HYDROVAC NEWS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES.

11.3 Cap on Liability

Our total liability to you for any claims arising from your use of the Services shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).

Any claim or cause of action arising from your use of the Services must be filed within one (1) year after such claim or cause of action arose, or it shall be forever barred.
